The petitioner has filed this petition under Section 11 of the Arbitration and Conciliation Act, 1996 ["the Act"] for appointment of an arbitrator to adjudicate disputes between the parties under a Master Franchise Agreement dated 01.05.2021 ["the Agreement"]. At the outset, I notice that it is stated in the Agreement that the respondent is a company incorporated in the United Kingdom. Consequently, by virtue of Section 2(1)(f)(ii) of the Act, the proposed arbitration constitutes an international commercial arbitration and a petition under Section 11 is maintainable only before the Supreme Court and not before this Court. 2.

At the request of Mr. Rajesh Kumar, learned counsel for the petitioner, the petition is dismissed as withdrawn with liberty to the ARB.P. 80/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
