The present appeal was partly heard yesterday and it was the appellant's contention that the documents referred to in the impugned order, copies of which were filed with the present appeal, were not provided to the appellant. It was also contended that the documents as available in the file of the learned Commercial Court record are also unreadable. This contention was challenged by the learned counsel appearing for the respondent. Accordingly, he was called upon to produce legible copy of the documents, which would reflect the respondent's use of the trade name in question in the course of business.

The learned counsel for the respondent has today handed over copies of the documents as filed before the learned Commercial Court. The said copies are legible. He states that he is also carrying the original of the said documents. It does appear that an incorrect statement was made by the learned counsel for the appellant that the documents filed by the respondent are not legible. 5.

None appears for the appellant.

It appears that the appellant is no longer interested in pursuing the present appeal. The petition and the pending application are dismissed in default.
