% 22.03.2017 After some hearing, learned counsel for the appellant seeks permission to withdraw the present Letters Patent Appeal and states that he would like to challenge the Rule relating to the penal rent and rate of penal rent.

In view of the statement made, the appeal is dismissed as withdrawn with liberty to the appellant to file appropriate proceedings challenging the clause relating to penal rent and the quantum of penal rent as specified in the office order dated 5th December, 2011 relating to allotment of residence/instructions.
