Learned ASC for the State accepts notice.
By this petition, the petitioner challenges communication dated 12th January, 2018 rejecting the parole application filed by the petitioner on the ground that the petitioner had earlier violated the terms and conditions of the parole granted to him previously. A perusal of the nominal roll reveals that the petitioner was granted two weeks parole by this Court w.e.f 22nd April, 2015 when the petitioner jumped the parole and could be re-arrested only on 1st September, 2015 when FIR No. 1187/2015 was registered against him. The petitioner has since undergone the sentence on conviction in FIR No. 1187/2015.
Considering the past conduct of the petitioner, the order passed by the W.P.(CRL) 563/2018
Competent Authority rejecting the application seeking parole by the petitioner cannot be said to be illegal, warranting interference. Petition is dismissed.
Copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
