O R D E R

% 14.03.2017 EX. APPL. (OS) 118/2017 This is a joint application filed on behalf of the parties, inter alia, stating that the parties have settled the amount payable and the Decree Holder has paid a sum of ₹74,41,419/- by a cheque dated 25.03.2017, drawn on Dena Bank, Rajendra Place, New Delhi after deducting the sum of ₹6,58,581/- on account of TDS. The Decree Holder undertakes that the said cheque would be honoured on presentation and further the TDS certificate for the tax deducted shall also be forwarded to the Decree Holder on or before 30.04.2017.

The learned counsel for the Decree Holder states that the Judgment Debtor No.1 is also holding a performance bank guarantee in the sum of ₹2,25,000/- which is liable to be released to the Decree Holder. The Decree Holder would be at liberty to approach to the Judgment Debtor No.1 for the aforesaid purpose.

It is needless to mention that if the Judgment Debtor No.1 has no claims against the bank guarantee, it will be released. Since the awarded amount has been discharged, the present petition is disposed of.
