O R D E R

The parties have amicably resolved their disputes through mediation. The terms of the settlement are recorded in the settlement agreements dated 08th October, 2018 and 22nd October, 2018 which are signed by both the parties.

Learned counsel for the plaintiffs submits that the settlement agreement dated 22nd October, 2018 is a confidential document and, therefore, the decree be passed in terms of the settlement agreement dated 08th October, 2018. The suit is decreed in terms of the settlement agreement dated 08th October, 2018 which is marked as Ex.C1 and shall form part of decree.

Defendant No.2 (M/s August Cinema (India) Pvt. Ltd.) has to pay a sum of Rs.7,50,000/- to the plaintiff in full and final settlement as recorded in para-2 of the settlement agreement dated 22nd October, 2018.

Mr. Shaji Nadesan, Director of defendant No.2, present in Court undertakes to pay Rs.7,50,000/- in terms of para-2 of the settlement agreement dated 22nd October, 2018 either from his personal account or from his proprietorship firm's account. Defendant No.2 is permitted to do so. The concerned bank of Mr. Shaji Nadesan shall permit him to transfer the amount in terms of the para-2 of the settlement agreement dated 22nd October, 2018.

Learned counsel for the plaintiff submits that defendant No.3 be deleted from the array of the parties. Defendant No.3 is deleted from the array of parties.

The suit as well as CCP(O) 40/2012 are disposed of in the above terms.

Copy of this order be given dasti to counsels for the parties under signature of Court Master.
