Through the present application, the petitioner seeks grant of regular bail in case FIR No. 646/2022, registered at PS Patpar Ganj Industrial Area, for the offences punishable under Section 307 of the Indian Penal Code, 1860.

Briefly stated, the facts are that on 04.09.2022, the petitioner attacked the complainant, Shivam, with a blade/paper cutter at his mobile shop in Nambardar Market, Ghazipur, in connection with a prior theft dispute, causing multiple stab injuries. The injured sustained wounds on the left lower portion of his scalp, the left upper chest, writs, and slightly below the left armpit, and was subsequently referred to Safdarjung Hospital for treatment. The petitioner was apprehended at the spot, and a blood-stained cutter was recovered, resulting in the registration of FIR No. 646/2022. 3.

petitioner is in judicial custody since 05.09.2022. It is submitted that the trial is at a nascent stage and the prosecution evidence is yet to be concluded. It is further pointed out that one of the witnesses, i.e. the victim has not fully supported the case of the prosecution and that the injuries sustained by the complainant are simple in nature.

Learned APP for the State has opposed the bail, contending that the victim has supported the case of prosecution in his chief examination before the learned Trial Court.

Upon query, learned APP for State has stated that the petitioner has no prior criminal antecedents and is not involved in any other case. 6.
I have considered the submissions. The specific allegation against the petitioner is that he attacked the complainant with a blade/paper cutter, resulting in simple injuries, as per the MLC No. 5608. The injuries are not to vital parts of the body. The petitioner has been in custody since 05.09.022 and has no previous criminal record. Considering that the trial may take considerable time to conclude, the facts weigh in favour of grant of bail. 7.
Accordingly, the petitioner is admitted to regular bail upon him furnishing a personal bond in the sum of ₹10,000/- with one solvent surety of the like amount to the satisfaction of the learned Trial Court subject to the following terms and conditions:
a. The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper with the evidence of the case, in any manner whatsoever.
b. The petitioner shall under no circumstance leave the country without the permission of the Trial Court;

c. The petitioner shall appear before the Trial Court as and when directed;
d. The petitioner shall provide the address where he would be residing after his release and shall not change the address without informing the concerned IO/SHO;
e. The petitioner shall, upon his release, give his mobile number to the concerned IO/SHO and shall keep his mobile phones switched on at all times.

It is made clear that the observations made hereinabove shall not be construed as an expression of this Court on the merits of the case before the learned Trial Court.

The bail applications, along with the other pending application(s), is allowed and disposed of in the afore-mentioned terms. 10.
Copy of the order be sent to the concerned Jail Superintendent for information and necessary action.
