A Petition under Section 482 Cr.P.C. read with Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of the FIR No.0693/2022 under Section 376 IPC read with Section 6 POCSO Act registered at Police Station Rajouri Garden, Delhi.

The brief facts as stated in the FIR No.0693/2022 dated 03.12.2022 are that about three years back the Petitioner had come to their home for delivering an online food Order and took the mobile number of Respondent No.2. Thereafter, the Petitioner started talking with the Complainant on phone and about one and half years back he took the Complainant to a Hotel The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. at Shadipur Depot and developed physical relations with her against her wishes. In the month of December, 2022 the Complainant felt pain in her stomach and was taken to Guru Gobind Singh Hospital, Raghubir Nagar, where she delivered a dead baby. The concerned Doctor called the Police and the FIR against the Petitioner was registered on the Complaint of the Complainant/Respondent No.2 at Police Station Rajouri Garden. 3.

It is submitted that Respondent No.2/Prosecutrix has got married to the Petitioner on 22.10.2024 and she has no objection to the quashing of FIR. It is submitted that the parties have entered into an oral Settlement. The Complainant submits that the Settlement has been arrived at without any pressure, force or coercion with her consent and therefore, the Petition be quashed.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 5.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 0693/2022 registered at Police Station Rajouri Garden, for offences punishable under Section 376 IPC read with Section 6 POCSO Act with all the subsequent proceedings and the charge sheet is hereby quashed qua the Petitioner.

The Petition stands disposed of.
