This petition has been filed setting aside the order dated 12th July, 2024 by which application the application under Section 311 Cr.P.C. was dismissed by the JMFC (NI-Act)-01, South East, Saket Courts, New Delhi. 2.

In the impugned order, it is noted that they sought to examine the Authorised Representative ('AR'), who was substituted post the assignment of the death of the complainant, to the new company. The new AR was Nirmal Singh, who was substituted on 21st June, 2023, only to represent the complainant. His evidence was not filed and he was never examined, hence, the question of examining him, did not arise. The assignment of debt would be considered, as an operation of law.

The impugned order has rightly dismissed the application filed under Section 311 Cr.P.C. It is rightly noted that the trial was at the stage of final arguments, and the said application was filed only to delay the proceedings. 4.
