The present petition has been filed seeking the following reliefs: "a) Issue a writ of mandamus or any other appropriate writ, order or direction directing the respondent to decide the passport renewal application of the petitioner in a reasonable time and thereby issued him renew passport; and b) Pass any other further orders/ directions as may be deemed fit and proper, by this Hon'ble court in the light of the facts and circumstances of the present writ petition."

As per the order dated 16.12.2024 passed by the trial court in criminal case no. 02/2024 pending before the Special Judge (PC Act), CBI-23 (MPs/MLAs Cases), Rouse Avenue District Court, New Delhi, one of the conditions for bail is to deposit the passport before the concerned Court. The order dated 16.12.2024 is extracted as under:- "16.12.2024 File taken up today on production of bail bond(s) and bail order dated 11.12.2024 passed by the Hon'ble Supreme Court in respect of A-1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The applicants have been admitted to bail by the Hon'ble Supreme Court, vide its order dated 11.12.2024. The operative portion of the said order is reproduced below for ready reference:- "The Special Court shall enlarge the appellants on bail on appropriate terms and conditions including condition of abiding by the undertakings furnished by them.

We make it clear that if the hearing of the complaint is delayed due to any act or omission on the part of the appellants, it will be open for the respondent to apply for cancellation of bail before the Special Court." In view of the directions of Hon'ble Supreme Court, the applicant/accused persons namely Zeeshan Haider and Daud Nasir released on regular bail on furnishing of personal bond in the tune of Rs. 1,00,000/- (Rupees One Lac only) each, with one respective surety of the like amount, subject to the following conditions:- (i)The applicants shall strictly adhere to and abide by all terms and conditions, which has been furnished in the form of undertakings before the Hon'ble Supreme Court. (ii) The applicants shall not leave Delhi/NCR without prior permission of this court.

(iii) The applicants shall deposit their passport, if any, with this Court.

(iv)The applicants shall provide their mobile numbers to the Investigating Officer on which they will remain available during the pendency of the trial.

(v) In case of change of residential address or contact details, the applicants shall promptly inform the same to the concerned Investigating Officer as well as to this Court. (vi)The applicants shall not directly/indirectly try to get in touch with the prosecution witnesses or tamper with the evidence. (vii) The applicants shall regularly appear before this Court during the pendency of the proceedings.

Bail bond(s) of Rs. 1,00,000/- (Rupees one lac only) each, with respect to A-1 Zeeshan Haider and A-2 Daud Nasir have been furnished by their respective Surety Sh. Mohammed Raza (for A-1) and Sh. Saud Nasir (for A-2) alongwith their passports. The same are accepted till 23.12.2024. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Release Warrant be prepared accordingly.

Ahlmad is directed to keep the passports in the judicial In the meanwhile, bail bond furnished by the accused persons be verified and report be filed by the Investigating officer on the date already fixed i.e. on 23.12.2024."

The matter is also covered by the decision of the Supreme Court in Mahesh Kumar Aggarwal vs. Union.1 which distinguishes between a permission to travel abroad and a renewal of passport. 4.

In view thereof, subject to compliance with the order dated 16.12.2024, the case of the petitioner will have to be considered in light of the pronouncement of the Supreme Court.

Let the respondent(s) to pass a reasoned order within a period of four weeks from today.

In any case, the renewal of the passport will not entitle the petitioner to undertake the journey unless he complies with other terms and conditions as imposed by the competent Court of jurisdiction. 7.

With the aforesaid observations, the instant petition stands disposed of.
