The petition has been filed with the following prayers:- "It is, most respectfully, prayed that:

i) To direct to respondents through the appropriate Writ/ Certiorari Writ to set aside the impugned order/orders dated 17.08.2005 and reinitiate/ restore the service of the petitioner.

ii) Direct through appropriate writ to respondents all claims and arrears and other consequences benefits of the service with 18% interest, interest of justice." Admittedly, challenge in this petition is to the termination order of the year 2005. The impugned orders reads as under:- "No. 86001135 L/NK Ganesh Singh, No 97254646 Ct Raj Kumar and No. 02254539 Ct. Pramod Kumar of 61 Bn. BSF have placed under open arrest on 16 Aug' 2005 vide this unit office O/No. 1280/Estt./61 Bn/SSFC/2005/1019599 dated 16 Aug'05 are hereby released from open arrest on 17 Aug'2005 at 1335 hrs.

No. 86001135 L/NK Ganesh Singh, No 97254646 Ct Raj Kumar and No. 02254539 Ct. Pramod Kumar of 61 Bn. BSF have been tried by summary security force court on 17Aug' 2005 at 1325 hrs and Found guilty of the charge and Court awarded sentence "to be dismissed from service".

There is no explanation for the delay in filing the petition. In the absence of any explanation, the petition is badly hit by delay and latches. The same is dismissed.
