The present petition assails order dated 06th June, 2024 passed by the District Magistrate, West evicting the Petitioners herein in accordance with the provisions of Maintenance and Welfare of Parents and Senior Citizens Act, 2007,1 and the rules framed thereunder.

An application seeking eviction of the Petitioners herein was filed by Late Mrs. Paramjit Kaur and Mr. Bachitter Singh under the Senior Citizens Act. The said application culminated in order of eviction dated 06th June, 2024 whereby Petitioners have been directed to vacate the property bearing no. G-30, Second Floor, Vishnu Garden, New Delhi-110018. It is pointed 1 "Senior Citizens Act"

out that during the pendency of the proceedings, both the senior citizens had deceased. Mrs. Paramjit Kaur deceased on 17th January, 2022 and Mr. Bachitter Singh deceased on 24th January, 2024. 3.
In light of the above, the order dated 06th June, 2024 which was passed only at the instance of senior citizens, is non est and, is no longer enforceable.

With the above declaration, the present writ petition is disposed of. 5.
The court has not examined the merits of the case. All rights and contentions inter se the Petitioner and other children of the deceased are left open.
