% 27.02.2017 CM Appl. 7529/2017 (exemption) in W.P.(C) 1679/2017 Allowed, subject to just exceptions.
W.P.(C) 1679/2017 Present writ petition has been filed seeking a direction to respondentDDA to allow petitioner's application for conversion from lease hold to free hold of property No.301, Third Floor, Kumar House, Plot No.6, D-Block, Local Shopping Complex, Prashant Vihar, Delhi. It is the petitioner's case that despite submitting all the documents for conversion of the aforesaid property and challan of Rs.3,00,140/-, the respondent vide letter dated 07th February, 2017 has requested the petitioner to submit GPA and Agreement to Sell executed by the builder duly stamped and space buyer's list approved by DDA.
Learned counsel for petitioner states that aforesaid requirements are vague because all the relevant documents are already in respondent-DDA's possession and the same were considered at the time of granting completion and occupancy certificate.
However, a perusal of the paper book reveals that petitioner has not sent any response to the respondent-DDA's letter dated 07th February, 2017. Consequently, the present writ petition is directed to be treated as response to respondent-DDA's letter dated 07th February, 2017 and to be disposed of by way of a speaking order within a period of six weeks in accordance with law.
With the aforesaid observations, present writ petition stands disposed of.
