The learned counsel for the appellant contends that since he had already challenged the order dated 26.07.2006 which will entail challenge to the order dated 05.09.2005 as well holding the appellant guilty firstly under Order 39 Rule 2A CPC and therefore, burdened with the punishment of 15 days imprisonment on account of alleged wilful disobedience of the orders passed by the trial Court, therefore, he does not press his present appeal. 2.
There is no appearance on behalf of the respondents. 3.
In view of the statement made by the learned counsel for the appellants, the appeal is dismissed as not pressed. 4.
Pending applications also stand disposed of.
