% 13.02.2026 CRL.M.A. 3993/2026 (under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with Section 490 BNSS on behalf of the Petitioner seeking permission to deposit money in lieu of Surety Bond) 1.

An Application has been filed on behalf of the Petitioner for modification of the Order dated 01.12.2025 to permit him to furnish cash surety in place of Surety Bond.

It is submitted that the Petitioner is a foreign national and has no person who can stand surety for him. In the circumstances he may be permitted to furnish the cash surety.

The Petitioner had been granted Bail vide Order dated 01.12.2025 subject to furnishing the Personal Bond and two Sureties of Rs.30,000/- each. The Order was modified vide Order dated 13.01.2026 whereby the Surety amount was reduced to Rs.20,000/- instead of Rs.30,000/-. However, in the present Application it is submitted that being a foreign national he is still not able to furnish the Surety.

Considering the circumstances stated in the Application, the impugned Order dated 01.12.2025 and 13.01.2026 are hereby modified with the directions that the Petitioner may furnish Cash Surety of Rs.30,000/- to the satisfaction of the learned Trial Court. The information of this Order be sent to FRRO for necessary action.
