The present petition filed under Section 9 of the Arbitration and Conciliation Act, 1996 (hereinafter „the A&C Act‟) seeks certain urgent interim orders.

It transpires during the course of hearing that an arbitral tribunal has already been constituted in terms of the arbitration agreement between the parties.

In the circumstances, it would be apposite if the present petition under Section 9 of the A&C Act is considered and dealt with by the duly constituted arbitral tribunal, under Section 17 of the A&C Act. It is directed accordingly.
