The petitioners seek quashing of FIR No.223/2014 under Sections 323/341/308/34 IPC, Police Station Fatehpur Beri based on a settlement.

Consequent to the settlement, the parties had jointly filed an application seeking compounding of the Cross FIR No.224/2014 under Section 323/341/34 IPC, Police Station Fatehpur Beri. The said FIR was compounded by order dated 26.10.2017. 3.

Respondent Nos.2 to 4 are present in Court in person, represented by counsel and identified by the Investigating Officer. They confirm that they have settled with the petitioner and do not CRL.M.C. 876/2018

wish to press the present complaint any further. 4.

In view of the fact that the parties have resolved their disputes and respondent No. 2 does not wish to press her complaint and in view of the fact that the cross-FIR No. 224/2014 has already been compounded by order dated 26.10.2017, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

In view of the above, the petition is allowed. FIR No.223/2014 under Sections 323/341/308/34 IPC, Police Station Fatehpur Beri and the consequent proceedings emanating therefrom are accordingly quashed.
