By way of present application, the petitioner/applicant seeks further extension of interim bail for a period of 30 days, granted to him by learned Vacation Judge, ASJ, West District, Delhi vide order dated 19.06.2024 and extended till 05.09.2024 by learned ASJ-04, West District, Tis Hazari Courts, Delhi on 05.08.2024, on the ground that the applicant's wife has to undergo surgery for fibroids cyst.

Learned counsel for the applicant submits that the aforesaid surgery could not be performed due to the applicant's wife suffering from severe The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
back pain and upon the doctor's recommendation of one month of physiotherapy before the said surgery. He further submits that the surgery is now scheduled for 01.10.2024. He also submits that the applicant's son, aged about 6 years, was also hospitalized and has been discharged only two days back.

Issue notice.

Learned APP for the State accepts notice and opposes the present application by contending that the applicant has been continuously seeking interim bail for the reason of his wife's surgery, which she has deliberately not undergone as yet. He submits that the applicant is a BC of the area, Thana Geeta Colony, Delhi. He further submits that the applicant is also an accused in FIR No.51/2023 registered under Sections 3 & 4 MCOC Act at P.S. Khyala, Delhi.

At this stage, learned counsel for the applicant submits that the applicant is already on interim bail in the aforesaid FIR No.51/2023 till 03.10.2024, granted vide order dated 19.06.2024 and extended vide order dated 03.08.2024.

Considering the aforesaid, the interim bail granted to the applicant on 19.06.2024 and extended on 05.08.2024, is further extended till 03.10.2024, on the same terms and conditions, as contained in the aforementioned order dated 19.06.2024.

The application is disposed of in the above terms. 8.
Even if the aforesaid surgery of the applicant's wife is not performed on 01.10.2024, the applicant is directed to surrender before the concerned Jail Superintendent on the expiry of the further extended period of interim bail, i.e., on 03.10.2024.
