The present petition has been filed by the petitioner assailing an order dated 05.07.2025 whereby permission has been granted to Sh. Arun Sharma for conducting/orgainsing of 'Ganesh Mahotsav' at Kalu Ram Chowk, near Police Station, Mehrauli, New Delhi.

The petitioner is also aggrieved with a communication dated 12.08.2025, issued by Office of the Deputy Commissioner of Police, South District, New Delhi whereby the request of the petitioner for organizing Ganesh Mahotsav at Kalu Ram Chowk, Mehrauli, New Delhi has been denied.

Prior to filing of the present petition, a writ petition being W.P.(C) 10473/2025 was filed by the petitioner seeking directions that the petitioner's application dated 15.04.2025 (to organize the aforesaid event) be processed/decided. Vide order dated 22.07.2025 in the said writ petition, it was inter-alia directed as under:

In case the respondents seek to grant permission for conducting / organising the concerned event to any other party other than the petitioner herein, the same shall be done with the leave of this Court in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It transpires from the Annexure-5, filed along with the present petition that as far as on 05.07.2025, permission to organize the concerned puja / event was granted to a third party subject to certain terms and conditions. The said letter is reproduced as under:

Learned Standing Counsel for the respondent submits that the decision to grant permission to the said person was guided by law and order considerations, in view of certain complaints received regarding the organization of event in the previous year/s. Further, it is submitted that the petitioner, having organized the event for the last many years, has no vested right to continue to do so in perpetuity.

It is further submitted that the permission granted vide Annexure-P-5 dated 05.07.2025 is subject to certain terms and conditions. It is assured and undertaken that if the said conditions are not adhered to by the person to whom the permission was granted, the authorities would not allow the event to proceed.

In view of the aforesaid contentions of the respondents, and considering that the concerned puja/event is to commence on 25.08.2025 and permission to the concerned person was granted as far back as on 05.07.2025, this Court does not find it apposite to interfere with the same at this stage.

In the circumstances, this court is not inclined to grant the relief as sought in the present petition. However, for future years, the respondents are directed to frame a cogent policy for the purpose of considering/processing the application/s received for organizing similar events. 9.
The petition, along with the pending application, is disposed of in the above terms.
