petitioner until further orders. Subsequently, vide order dated 09.08.2024, respondent no. 1 was directed to provisionally grant admission to the petitioner in Class Nursery/Pre-primary, in accordance with the shortlisting exercise conducted by the Directorate of Education. Pursuant to the said order, respondent no. 1 School granted admission to the petitioner, who is now regularly attending classes. In light of these circumstances, the order dated 09.08.2024 is made absolute, and the petitioner‟s admission shall be regularized. This, however, shall be without prejudice to the rights and contentions to be raised by the respondents in their counter-affidavits, with all contentions remaining open.
Thus, the School shall proceed with the regularization of the petitioner‟s admission and ensure the provision of all facilities mandated under the RTE Act 2009, for children belonging to the EWS category.
