The learned counsel for the respondent, on instructions, submits that he has no objection if the complaint is restored to its original number, on the respondent being compensated and the petitioner not taking unwarranted adjournment before the learned Trial Court.

The learned counsel for the petitioner submits that the matter would be pursued diligently and no adjournment would be taken before the learned Trial Court.

Considering the above, the complaint case bearing no.4230/2017 is restored to its original number. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 15/10/2024 at 12:00:58

The matter is directed to be listed before the learned Trial Court on 03.12.2024 and the learned Trial Court is directed to take up the matter from the stage as obtained on 26.07.2023. 5.

The petitioner is directed to pay a cost of ₹25,000/- to the respondent within a period of three weeks.

In view of the above, the impugned order dated 26.07.2023 is set aside, and the present petition is allowed in the aforesaid terms.
