The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter "BNSS") [earlier Section 482 of the Code of Criminal Procedure, 1973 (hereinafter "CrPC")] has been filed by the petitioner praying for quashing of FIR no. 332/2024 registered at Police Station New Ashok Nagar for the offences punishable under Sections 289/106 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter "BNS"). 2.

According to the FIR, it is alleged that on 29.07.2024, at around 7:30 PM, the deceased Ashim Halder, who was working as a helper in the shoematerial factory located in the basement, was trying to connect the bare wire of a fan to an electric board when he received a sudden electric shock and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

collapsed. He was immediately taken to LBS Hospital where the doctor declared him "Brought Dead". The police examined the spot and concluded that the death occurred due to negligence in handling electrical equipment and unsafe electrical wiring at the workplace. Based on this, the instant FIR was registered.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner and respondent no. 3 (father of the deceased) have settled their disputes amicably and are now moving forward towards a peaceful and harmonious future.

Settlement deed dated 31.07.2024 is on record and has been annexed as Annexure-C. Qua this deed, the respondent no. 3 has agreed to withdraw the case arising out of the instant FIR against the petitioner. 5.

At this juncture, the respondents no. 2 (informant) and 3 (father of the deceased) submitted that they have no objection if the present FIR may be quashed on the basis of the aforesaid compromise. 6.

It is thus prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise. 7.

Learned APP for the State submits that there is no opposition to the prayer made by the petitioner seeking quashing of the FIR in question in view of the settlement arrived at between the parties. 8.

Heard learned counsel for the parties and perused the record. 9.

The petitioner is present before this Court and have been identified by their counsel and Investigating Officer, Police Station New Ashok Nagar. Respondents no. 2 (informant) and 3 (father of the deceased) are also present in the Court and have been identified by the Investigating Officer. On a query made by this Court, respondent no. 3 has categorically stated he has entered into compromise on his own free will and without any pressure. It is also stated that the entire dispute has been amicably settled between the parties and he has received the entire sum of Rs. 2,50,000/- from the petitioner.

Keeping in view the fact that the matter stands amicably been settled between the petitioner and respondents no. 2 and 3 amicably and without any pressure, no fruitful purpose would be served by keeping the matter pending.

Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR no. 332/2024 registered at Police Station New Ashok Nagar for the offences punishable under Sections 289/106 of the BNS, and consequent proceedings emanating therefrom, are quashed qua the present petitioner. 13.

The petition alongwith pending application(s), if any, stands disposed of.
