Learned SPC appearing physically along with the Assistant Controller appearing through video conferencing submits that in the peculiar facts and circumstances involved herein it is in the interest of justice if the appellant is granted a fresh/ de novo hearing for due and proper adjudication of the patent application no.201717015945. 2.
Learned counsel for the appellant has no objection if the present proceedings are remanded for adjudication by the respondent after giving a fresh/ de novo hearing to the appellant.

In view of the aforesaid, the Joint Controller of Patents, Designs and Trademarks shall ensure the listing of the Patent Application no.201717015945 for a fresh/ de novo hearing within a period of two The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. weeks from today, as also make all possible endeavours for the disposal of the same within a period of two months thereafter, after hearing the learned counsel for the appellant, during which period no unnecessary adjournment(s) shall either be sought by the learned counsel for the appellant and/ or be granted by the learned Joint Controller. 4.
Learned counsel for the appellant submits that he has no objection to the same and that he shall approach the Controller within a period of one week.

Accordingly, the present appeal is disposed of in the aforesaid terms.
