This petition is filed under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the Arbitral Tribunal.

Disputes having arisen between the parties in relation to Concession Agreement dated 20.04.2006, three-member Arbitral Tribunal was constituted to adjudicate the disputes between the parties. Mandate of the Arbitral Tribunal was extended by a period of six months on expiry of the initial mandate. Extended mandate has expired on 20.08.2025. It is stated that arbitral proceedings are at the stage of arguments on an application filed by the Petitioner under Section 17 of 1996 Act as also an application filed by the Respondent under Section 23(3) for amendment of Statement of Defence.

Learned counsel for the Respondent, on instructions, submits that Respondent has no objection to the extension of mandate of the Arbitral Tribunal.

Accordingly, with the consent of the parties, mandate of learned Arbitral Tribunal is extended by a period of 12 months from 21.08.2025. 5.
