The learned counsel for the plaintiff prays for leave to withdraw the present suit with liberty to file afresh before a Court of competent jurisdiction.

The suit is accordingly, dismissed as withdrawn with liberty as prayed for.

As the plaintiff has withdrawn the suit before summons could be issued to the defendants, the plaintiff is entitled to refund of the court fee deposited with the plaint.

The Registry is directed to prepare a certificate of refund in favour of the plaintiff and hand it over to the learned counsel for the plaintiff.

The pending applications are disposed of as having become infructuous.
