This is a Testamentary case filed seeking Probate of Will dated 06.1.2011 of Late Smt. Krishna Lamba.

The petition was filed on 11.04.2012, but the petitioner failed to adduce any evidence or file any affidavit of any witness.

The evidence of the petitioner was closed on 13.1.2017. Subsequently, an application I.A.13458/2017 was filed on behalf of the petitioner seeking permission to lead the evidence. However, this I.A. had been withdrawn vide Order dated 22.10.2018 with permission to file a Chamber Appeal against the said Order. However, no Chamber Appeal has been filed on behalf of the petitioner, nor has the petitioner appeared thereafter.

Considering that no evidence whatsoever, has been led by the petitioner in the present case and has also not appeared, the petition is dismissed in default of appearance and for non-prosecution.
