% 26.02.2018 Petitioners are seeking quashing of the present FIR i.e., FIR No. 33/2016 registered at Krishna Nagar under Section 341/354/506 read with Section 34 of the IPC on the complaint of respondent No. 2. Respondent No. 2 is present in person; her presence has been identified by the investigating officer. Respondent No 2 is the wife of petitioner No. 1. It is stated that the allegations had been levelled against her husband out of misunderstanding between the parties. Parties have settled their disputes. They are living together peacefully since February 2016. Parties also have two children born out of their wedlock aged 17 years and 10 years. The memorandum of understanding arrived at inter se the parties dated 10.02.2016 is on

record duly signed by the parties. Parties endorse the settlement. This is a fit case where the prayer made in the petition should be granted. Accordingly, to secure the ends of justice, FIR No. 33/2016 registered at Krishna Nagar under Section 341/354/506 read with Section 34 of the IPC and all the proceedings emanating therefrom are quashed.

Petition disposed of in the above terms.
