% 12.09.2024 After making brief submissions in the matter, Mr. Kamlesh Kumar Mishra, learned counsel appearing for the petitioner submits, that since the Investigating Officer has now informed that respondent No.3 (the father who is the accused in the matter) has surrendered back to custody upon expiration of interim bail granted vide order dated 02.09.2024 by the learned Sessions Court, the matter has been rendered infructuous; and may be disposed-of as such.

Mr. Mishra submits, that the legal issue raised, namely whether the petitioner was granted an effective opportunity of participating in the interim bail proceedings, be left open.

The petition is accordingly disposed-of as infructuous, leaving open the issue raised by Mr. Mishra.
