The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.190 of 2017 under Sections 363/366/376 IPC and Section 6 of POCSO Act, PS Mainwali Nagar.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 27th May, 2017. The petitioner was aged around 16 years on the date of occurrence. In her 164 Cr.P.C. statement, the victim did not support the prosecution. She informed that she had accompanied the petitioner with her free consent and had performed marriage with him. She was a consenting party. 4.
Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the sum of `40,000/- with one surely in the like amount to the satisfaction of the Trial Court. 5.
The application stands disposed of.
