O R D E R

The petitioners seek quashing of FIR No.21/2014 under Sections 323/308/452/392/394/32 IPC, Police Station Harsh Vihar, based on a settlement.

The subject FIR was registered consequent to a quarrel between the parties. The parties are neighbours. Parties have settled their disputes with the intervention of respectable members of the locality as well as relatives.

Respondent Nos.2 to 4 is present in Court in person and identified by the Investigating Officer. They confirm that the CRL.M.C. 963/2018

settlement has taken place and they do not wish to prosecute the complaint any further.

In view of the above and keeping in view of the fact that parties have resolved their disputes with the intervention of respectable members of the locality and relatives and respondent Nos. 2 to 4 do not wish to press their complaint, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

Accordingly, FIR No.21/2014 under Sections 323/308/452/392/394/32 IPC, Police Station Harsh Vihar, and the consequent proceedings emanating therefrom are hereby quashed subject to payment of costs of Rs.10,000/- to be deposited by the petitioners with the 'Prisoners Welfare Fund Jail No.13, Mandoli', Mangal Pandey Marg, Harsh Vihar, Village Mandoli, Delhi. The costs be deposited within a period of two weeks and receipt of deposit of costs be furnished to the Investigation Officer within a period of three weeks.
