1. The present appeal under Clause X of the Letters Patent seeks to assail the order dated 22.09.2023 passed by the learned Single Judge in W.P.(C) 11978/2021.

Vide the impugned judgment, the learned Single Judge has rejected the appellant's writ petition by holding that since the respondent is a private company, no writ petition against the respondent could be entertained.

2. At the very outset, learned counsel for the appellant submits that he wishes to incorporate additional grounds. He, therefore, seeks leave to withdraw the appeal with liberty to file a fresh appeal incorporating additional grounds.

3. Since the appeal is at the initial stages, the same is along with pending applications is dismissed as withdrawn with liberty as prayed for. 4. It is, however, made clear that merely because the appellant is being granted liberty to file a fresh appeal, would not amount to expression of any opinion by this Court.
