Appeal has been filed on behalf of the Appellant Sh. Narendra Kumar Verma, son of deceased Late Sh. Bali Verma, who died in a road accident on 27.02.2017.

Vide impugned Award dated 14.02.2024 a total compensation in the sum of Rs.51,56,185/- along with interest @ 6% per annum has been granted. The deceased, Mr. Bali Verma was survived by his wife, Smt. Anita Verma, two daughters who are Respondent Nos.2 & 3 and two sons Narendra Kumar Verma who is the Appellant and Sh. Shubham Verma, Respondent No.4.

The only grievance of the Appellant is that from the entire Compensation amount only Rs.44,000/- each has been awarded to the four children of the deceased, which include the Appellant and Respondent Nos.2 to 4.

Respondent No.1, Anita Verma is the second wife of Late Sh. Bali Verma. After the demise of the father, she has refused to give him any share in the properties of the father. She is, therefore, not entitled to get the major chunk of the compensation amount and he, being the son of the deceased, should have been granted higher amount of compensation. The only grievance of the Appellant, therefore, is towards the apportionment of Rs.44,000/- to him from the entire compensation amount, while about Rs.50 lacs have been awarded to Smt. Anita Verma, the second wife of the deceased. 5.

On a specific query, learned counsel has submitted that his own mother died soon after his birth in 1988 and thereafter their father had married Smt. Anita Verma. The counsel submits that all the four children of late Sh. Bali Verma had been brought up by the father and their second mother.

The Appellant is now 40 years old and is married. He is living separately since about last five years. He is financially independent. 7.

Submissions Heard.

It is evident from the Award that the four children of late Sh. Bali Verma have been given compensation on account of loss of consortium in the sum of Rs.44,000/- each. There is no ground to vary the apportionment as awarded by the learned Tribunal. 9.
