O R D E R

% 04.12.2015 Learned counsel for the defendant nos.1 & 2, on instructions of the defendants, submits that defendant nos.1 & 2 have already changed the name of the company from 'Verizon Builders and Developers Ltd.' to 'Inca Developers Ltd.'. It is further submitted that defendant nos.1 & 2 will not use mark 'Verizon' in future for their business. It is further submitted that defendants have also given up and surrendered the domain name www.verizonbuilder.com. It is further submitted that defendant nos.1 & 2 shall jointly or severally pay Rs.50,000/- to the plaintiffs. Learned counsel for the plaintiffs submits that in view of the statement of the learned counsel for the defendant nos.1 &2, suit is not pressed qua the defendant no.3 and

prayer no. (i), (ii) & (iii) are sought against the defendant nos.1 & 2. Learned counsel for the defendant nos.1 & 2 has also no objection if the decree is passed in terms of prayers (i), (ii) & (iii). Accordingly, suit is decreed in favour of the plaintiffs and against the defendant nos.1 & 2 for prayers (i), (ii) & (iii). A decree in the sum of Rs.50,000/- is also passed in favour of the plaintiffs and against the defendant nos.1 & 2. Defendants, however, are given eight weeks time to pay the decretal amount by way of demand draft in the name of the plaintiff no.3. Miscellaneous applications are disposed of as infructuous. A.K.
