By way of the present petition under Article 226 of the Constitution of India, the petitioner has approached this Court assailing the order dated 19.02.2024 passed by the respondents vide which recovery of a sum of Rs. 1,11,000/- was sought to be made from the petitioner on the basis of the findings of a Court of Inquiry.

At the very outset, learned counsel for the respondents who appears on advance notice submits that the impugned order dated 19.02.2024 already stands superseded by an order passed by this Court on 04.05.2024. A copy of the said order has been handed over to the learned counsel for the petitioner, who seeks leave to withdraw the present petition with liberty to assail the order dated 04.05.2024, in accordance with law. As prayed for, the writ petition along with the pending application is dismissed as not pressed, with liberty as prayed for making it clear that once this Court has not expressed any opinion on the merits of the rival contentions of the parties, it will be open for the petitioner to raise all grounds, including the grounds raised in the present petition, in any fresh petition which he may chose to file.
