% 25.08.2025 1.
The present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 482 of the Code of Criminal Procedure, 1973) seeks expeditious disposal of SC No. 406/2019 in FIR No. 188/2019 under Sections 302/34 of the Indian Penal Code, 1860 at P.S. Vivek Vihar pending before ASJ (FTC), Shahdara, Karkardooma Court, Delhi.
2.
The Petitioner's previous bail application was rejected by this Court by order dated 30th April, 2025 in BAIL APPLN. 4653/2024. The challenge to the afore-noted order was rejected by the Supreme Court by order dated 11th June, 2025 in Special Leave to Appeal (Crl.) No. 8821/2025. the Supreme Court declined to interfere with the order of this Court, directions were issued to the Trial Court to expedite the trial. 3.
The Petitioner submits that despite Supreme Court's categorical direction for expediting trial, the trial has not seen any substantial progress. In light of this, the Petitioner seeks fixing of specific timelines for completion of the trial.
4.
Mr. Mukesh Kumar, APP for State, apprises the Court that the examination of one of the key witnesses, Ms. Shashi Bala (wife of the deceased), is scheduled for 4th September, 2025. He further submits that following her deposition, only formal witnesses remain to be examined and assures that every effort will be made to record the evidence at the earliest. 5.
Heard. While this Court acknowledges that the trial has been pending since 2019, however the Supreme Court has not fixed any timelines for conclusion of trial. In such circumstances, this Court finds no compelling reason to impose strict deadlines for conclusion of trial. Nonetheless, the Trial Court is directed to endeavour to conclude the proceedings expeditiously, subject to the constraints of its existing roster. 6.
With the above directions, the petition along with pending application, is disposed of.
