Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.‟) (Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioners, for quashing of FIR No.177/2021 dated 01.04.2021 under Section 308/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC‟) registered at Police Station Prem Nagar (Rohini District) and all the consequential proceedings emanating therefrom, in view of the Settlement Deed dated 02.06.2025. On advance Notice, learned APP has appeared and accepted the Notice on behalf of the State.

The Complainant/Respondent No. 2 is present in person. It is submitted that he has received the settled amount and is willing to compromise. However, all the allegations as per the FIR, show that the Accused persons/Petitioners, on 30.03.2021 at about 10:00 p.m, had accosted the Complainant and given him beatings with a rod because of which, he fainted. The MLC shows that he had fractures of right clavicle and left fibula. Thereafter, Mr. Santosh/Respondent No. 3 came there and when he tried to free the Respondent No. 2, Ravindra and Inderjeet beat him up as well. The injury suffered by him, were grievous. 7.

On the Complaint of the Respondent No.2/Complainant, FIR No.177/2021 dated 01.04.2021 under Section 308/34 of IPC, got registered at Police Station Prem Nagar (Rohini District). The Petitioners also lodged a cross-FIR No. 0178/2021 dated 02.04.2021 under Sections 323/341/34 of IPC at Police Station Prem Nagar, Delhi, against the Respondents, for the same incident. The Charge-Sheet has also been filed at Police Station Prem Nagar, in the respective FIRs.

With the intervention of elders, respected members of society and well-wishers from both the parties, the parties have settled the dispute between them vide Settlement dated 02.06.2025 and in lieu thereof, the Petitioners have agreed to pay a sum of Rs.25,000/- each, by way of Demand Draft, to the Respondent No. 2/Complainant and the Respondent No. 3/injured, respectively.

they have no objection if the said FIR is quashed. The parties have been identified by their learned counsel and Investigating Officer concerned. 10.

Looking at the surrounding circumstances in which the incident happened and the nature of injuries, it is considered not a fit case for quashing.
