% 31.08.2017 I.A.No.9934/2017 By the present application filed under Order 7 Rule 11 CPC. The learned counsel for the respondents submits that he would like to withdraw the present application with liberty to raise all his objections before the learned arbitrator.

Granting leave and liberty as prayed for, the present application is dismissed as withdrawn.

O.M.P.(I) (COMM.) 87/2017 The learned counsel for the petitioner submits that the petitioner has invoked the arbitration clause and proposed to appoint Sh.Siddharth Tomar, Advocate as a sole arbitrator to adjudicate the disputes between the parties. The learned counsel assures that the appointment process will be completed within one month from today.

Accordingly, the present petition is disposed of with liberty to the respondents to approach the learned arbitrator for clarification/modification

of the interim order dated 21.02.2017. The interim order dated 21.02.2017 shall continue to operate till clarification/modification, if any, by the learned arbitrator at the request of the respondent/passing of Award. JAYANT NATH, J.
