O R D E R

% 08.03.2018 Mr. Srivastava states, as per his instructions the electricity pole, of which shifting is sought in the present petition, can be shifted to a distance of 14 meters, on either side, that too subject to payment of cost by the petitioner and the petitioner submitting NOC of the other shopkeepers (if any).

Learned counsel for the petitioner states, the petitioner has already given a representation in that regard to the respondent No.2. He also, in other words, reiterates, the petitioner shall bear the cost of shifting, provide NOC of the other shopkeepers (if any) and also identify the place, within the

permissible limit of 14 meters, where the electricity pole can be shifted. In view of the said statement, the petition is disposed of with a direction that the representative of the petitioner and the respondent No.2 shall hold a meeting at the site within one week from today when the petitioner shall identify the place; pursuant thereto, the respondent no.2 shall notify the petitioner, the cost involved for shifting of the pole. Once the cost is deposited and NOC (if any) is provided to the Respondent no.2, further action shall be taken and completed by the respondent no.2 within two months thereafter.
