This petition is filed on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the learned Sole Arbitrator by a period of one year.

Disputes having arisen between the parties in relation to Agreement bearing No. 10/EE/BPD B-231(N)/2014-15, Respondent appointed an Arbitrator on 03.07.2019 for adjudication of the disputes. The Arbitrator, however, terminated the proceedings and in OMP(T)(COMM) 105/2019, this Court vide order dated 11.12.2019 appointed a substitute Arbitrator. Mandate of the Arbitrator was extended by this Court vide order dated 23.01.2024 in O.M.P.(MISC.)(COMM.) 619/2023 by a period of six months. Mandate of the Arbitrator has expired on 23.07.2024 and arbitral proceedings are at the stage of recording evidence. 3.

Mr. Pramod Kumar, learned counsel accepts notice on behalf of the Respondent and on instructions, submits that Respondent has no objection to the extension of mandate of the Arbitrator.

Accordingly, with the consent of the parties, mandate of the Arbitrator is extended by 09 months from 25.08.2025 and period between 24.07.2024 to 24.08.2025 is regularized.

Petition is allowed and disposed of in the aforesaid terms.
