The present petition under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 482 of the Code of Criminal Procedure, 1973) seeks grant of parole for a period of 4 weeks.

The Petitioner is a convict in FIR no.248/2010 registered under Sections 376(2)(g)/365/506/34 of the Indian Penal Code, 1860 at P.S. Dhaula Kuan and is currently serving life imprisonment. 3.
The Petitioner now seeks parole on account of medical condition of his wife, who has been advised to undergo surgery. The medical record furnished by the Petitioner has been verified by the State. The surgery to be performed on Petitioner's spouse is scheduled for 28th August, 2025. Mr. Yasir Rauf Ansari, ASC for the State, points out that the Petitioner last availed furlough from 28th May 2025 to 1st August 2025, and the one-month period between the Petitioner's surrender and the current request for parole has not yet elapsed. Mr. Rauf further submits that the nominal roll indicates that the co-convicts, Iqbal and Kamruddin, are currently released from custody, and therefore the bar under Rule 1212, Note (2) of the Delhi Prison Rules, 2018,1 is applicable. 5.
The State has handed over the copy of the status report and nominal roll which are taken on record.

As per the nominal roll, the Petitioner has been in custody for 13 years, 09 months and 07 days and has also earned remission of 02 years, 06 months and 06 days.

The Court has considered the contentions of the parties and perused the status report. As already noted, the State has verified the medical documents pertaining to the Petitioner's wife. The doctor has confirmed that she is diagnosed with calculus cholecystitis and advised to undergo laparoscopic cholecystectomy, and surgery scheduled for 28th August 2025. The Petitioner's overall jail conduct as well as past one year's jail conduct has been satisfactory, except for one punishment dated 21st November, 2024 for failing to surrender on time after being released on furlough. However, he has been released on furlough even subsequent to this infraction. 8.
In light of these facts, coupled with the exceptional circumstances relating to the medical condition of the Petitioner's wife, and pursuant to the relaxation provided under Rule 1212, Note 2 of the DPR, the Petitioner is directed to be released on parole for a period of four weeks upon furnishing 1 "DPR"

a bail bond in the sum of INR. 10,000/- with one surety of the like amount, to the satisfaction of the concerned Jail Superintendent, subject to the following conditions:
(i) The Petitioner shall report to the concerned SHO(s) once a week on every Monday during the period of parole.
(ii) The Petitioner shall furnish his telephone number to the SHO(s) concerned, which the Petitioner will keep operational at all times. (iii) The Petitioner shall surrender before the Jail Authorities at the expiry of the period of parole.

The petition is disposed of in the above terms. 10.
