Petitioner, already on second spell of furlough for the period from 12.08.2025 to 27.08.2025 seeks extension of the furlough up to 12.09.2025 by way of third spell. Learned ASC accepts notice and points out that petitioner himself filed the application before competent authority in this regard much belatedly on 18.08.2025, i.e. just two days before filing this petition, so the competent authority shall decide the application expeditiously in accordance with rules.

The third spell of furlough is sought on the ground that daughter of brother-in-law of petitioner is getting married on 02.09.2025. There is nothing on record to show as to why the application before competent authority was filed so belatedly on 18.08.2025. Further, learned ASC also strongly opposes the petition on the ground that there is no provision to allow next spell of furlough, ignoring the gap between two spells required by law. I also find substance in the submission of learned ASC that petitioner is trying to abuse the process of law and ensure evergreening of his liberty.

Considering the above circumstances, the petition as well as the accompanying application is dismissed.
