O R D E R

These writ petitions are filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- W.P.(C) 12866/2025 "A. The writ of mandamus directing the respondents to render complete and full accounts to the petitioner in relation to the sale of the mortgaged property, i.e., Riyasat Farm House, falling in khasra no. 1127/2/2 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

1128/2/2, 1129/2, 1130/2, and 1131/1 of village Chattarpur, New Delhi, situated at village Chhatarpur, Mehrauli, New Delhi, which belonged to the petitioner and was illegally sold by the respondent bank under the provisions of the Sarfaesi Act at much below the market price in a private treaty B. The petitioner additionally prays before this hon'ble court to direct the bank to pay such interest @18.5 % compoundable interest to be recovered from the bank, which the bank has recovered from the petitioner in the past.

(OR in alternative may kindly) C. Direct the respondent's Bank to refund the excess money received by them to the tune of Rs. 1,94,48,069/- along with interest @ 13% per annum since 01/07/2017, I.E., Rs. 4,42,56,629/- which has been illegally withheld by the bank and has been recovered from the petitioner after selling his land.

D. Pass any other further orders this hon'ble court deems fit and proper in the facts and circumstances of the case and in the interest of justice" W.P.(C) 12899/2025 "a) The writ of mandamus directing the respondents to render complete and full accounts to the petitioner in relation to the proprietorship concern namely Hindustan Trading Company, namely Hindustan Trading Company, which belonged to the petitioner.

b) Further Direct the Respondents to refund the Excess Amount Recovered from the Petitioner after Selling his Assets, i.e., Land admeasuring 14 Bighas at Village Chararpur Delhi i.e., to the Tune Of Rs. 30,00,000/- (Thirty Lakhs Only) Alongwith Future Interest@ 13 % Per Annum Which Has Been Illegally Withheld By The Bank.

c) Pass any other further orders this hon'ble court deems fit and proper in the facts and circumstances of the case and in the interest of justice." 2.

Mr. Rajeev Sagar, learned counsel accepts notice on behalf of the Respondents.

Learned counsel for the Petitioner submits that it would suffice at this stage, if a direction is issued to treat these writ petitions as representations of the Petitioner and look into the grievances raised therein including furnishing of details relating to sale of mortgaged property i.e., Riyasat Farm The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

House as also details of proprietorship concern namely Hindustan Trading Company.

Accordingly, without entering into the merits of the case, these writ petitions are disposed of directing the Respondents to treat these writ petitions as representations on behalf of the Petitioner and look into the grievances ventilated by the Petitioner. Decision will be taken within a period of four weeks from today and communicated to the Petitioner within one week from the date of decision, who may take recourse to legal remedies, if so advised. It is made clear that since these writ petitions are disposed of with a limited direction, the question of maintainability is left open.
