Kundan Singh v. State
$~8.
* IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(CRL) 673/2016 KUNDAN SINGH ..... Petitioner Through:
Mr. Ajay Verma & Ms. Katyayini, Advocates.
versus STATE ..... Respondent Through:
Mr. Sanjay Lao, ASC along with SI Vinod Kumar, PS-Mehrauli, for the State.
CORAM:
HON'BLE MR. JUSTICE VIPIN SANGHI
O R D E R
% 09.12.2016 The petitioner has preferred this writ petition to seek quashing of the order dated 01.02.2016 rejecting the petitioner's application for parole. He also seeks that he be released on parole for a period of three months to be able to prefer a Special Leave Petition.
The nominal roll shows that the petitioner is a convict in case FIR No.592/2007 under Section 302/ 201/ 404 IPC registered at PS - Mehrauli. He is undergoing life imprisonment. He has undergone incarceration of 8 years, 10 months and 26 days as on 28.08.2016. His jail conduct has been found to be unsatisfactory. He has been inflicted several punishments,
including on 16.05.2016 and 09.08.2016. The last punishment inflicted on 09.08.2016 is in relation to the petitioner attacking another inmate with a sharp-edged steel object due to which the inmate suffered injuries. Looking to the jail conduct of the petitioner, I am not inclined to release him on parole. The petitioner can always prefer a Special Leave Petition from the jail itself.
The petition is, accordingly, dismissed. However, in case the petitioner's jail conduct improves, it shall be open to him to seek parole at an appropriate stage.
