This petition has been filed seeking directions to the respondents to allow petitioner to peacefully vend at his particular vending site on the footpath, near Kashmere Gate Metro Station Gate No. 7, City SP Zone, Ward-84-N, New Delhi.

Petitioner holds a Certificate of Vending (COV) which is extracted as under:

Counsel for petitioner states that he has already made a representation dated 10th August 2025, relating to the same, which is appended as Annexure P-4 to the petition.

He further relies on an order passed on 30th May 2024 by the Division Bench of this Court in W. P (C) 2265/2024 titled as "Shiv Prasad and Ors v. Municipal Corporation of Delhi and Ors", wherein in respect to some other vendors, diretions have been passed by the Court for addressing the issue of increasing the period of time to allow to vend for a fixed place, and in that regard, following direction was passed, which is extracted as under: " 5. At this stage, the learned counsel appearing for the respondents seeks further time to take instructions as to a possible interim plan in order that all street vendors are not evicted on a daily basis."

Notice are accepted by Mr. Siddharth Nath, Standing Counsel appearing on behalf of respondent nos. 1-2, Ms. Urvi Mohan, counsel who appearing on behalf of respondent no.3 and by Ms. Suruchi Mittal, counsel appearing through VC on behalf of the respondent nos. 3-4 respectively. 7.
It is stated that vending can only be allowed to the petitioner as per the conditions of the COV, specifically 'Condition No. 11' relating to mobile vending, not more than 30 minutes.

As regards the directions passed by the Division Bench of this Court on 30th May 2024, in case, compliance is not being made with the said order, it will be open to the petitioner in that matter to seek their remedy. 9.
As regards the present matter, the petition is disposed of with a direction to the respondents not to disturb vending if done in accordance with the conditions of the COV.

Needless to state the petitioner cannot choose to hawk in the 'No hawking, no vending zone'.
