Although the appellant seeks to challenge the impugned order dated 01.05.2025 passed by Ld. District Judge-03(Shahdara), Delhi in MISC DJ 686 of 2024 in Execution Petition No. 115/2015 however, inadvertently, he has not prayed for such relief in the present appeal. 2.
Learned counsel for the appellant submits that he had moved an application before the Executing Court seeking modification/ rectification of the order dated 27.07.2024 and though vide impugned order dated 01.05.2025 the learned Executing Court has returned findings qua the FDR in the name of Judgment Debtor lying with the Registrar General, Delhi High Court as also that in the name of the Registrar General, Delhi High Court as well, however, the remaining amount which was to be calculated in terms of the order dated 22.12.2014 passed by this Court, has been left open. Moreover, the same has also been disposed of vide the same order itself. 3.
Learned counsel for the appellant seeks to withdraw the present appeal with liberty to either file a review or move an appropriate appeal challenging the said order before this Court. 4.
Accordingly, the present appeal, along with the pending applications, stands dismissed as withdrawn.
