The grievance in the present petition is with respect to order dated 22.07.2025 whereby the learned Appellate Tribunal, MCD has merely asked NHAI to render requisite assistance to the Tribunal with respect to the controversy raised in the appeal filed by appellant/respondent No.2 herein. The arguments on the interim application have been heard in part and the learned Tribunal has already given a date for addressing final arguments on interim application as well on the appeal and in the interregnum, it has directed the concerned appellant (respondent No.2 herein), not to carry out any further construction on the property.

After hearing arguments for some time, learned counsel for petitioner, without prejudice to her rights and contentions, does not press the present petition. She submits that the petitioner herein would raise appropriate arguments before learned Tribunal in order to demonstrate that the appeal is totally misconceived and no interim direction can be passed in favour of appellant (respondent No.2 herein).

In view of above, present petition is hereby dismissed as not pressed. 7.
