Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.‟) (old provision Section 482 of the Code of Criminal Procedure, 1973) (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioner, for quashing of FIR No.348/2025 under Section 3(1)(r)/3(1)(s) of SC & ST (P) Act, registered at Police Station K.N. Katju Marg and all the consequential proceedings emanating therefrom, on the basis of the Settlement dated 05.08.2025. On advance Notice, learned APP has appeared and accepted the Notice on behalf of the State.

The Petitioner is a market President while the Complainant/Respondent No.2 has a stall of coconut water, on the pavement. The petitioner has not allowed, putting his stall on the pavement, which raised the instant dispute.

On the Complaint of the Respondent No.2/Complainant, FIR No.348/2025 under Section 3(1)(r)/3(1)(s) of SC & ST (P) Act, registered at Police Station K.N. Katju Marg 8.
It is submitted on behalf of the State that the Closure Report has already been filed. Since the investigations revealed that at the time of incident, Accused was not aware about the caste status of the Complainant also the Defendant‟s witnesses did not support the incident. 9.
With the intervention of the neighbours and market persons, the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 05.08.2025. In the Settlement, it was inter alia settled between the parties that the Respondent No. 2 has settled all rights, claims, losses and damages of any kind whatsoever without any monetary consideration. It is also settled that both the parties shall not file any civil/criminal case, Complaint, Application etc. against each other arising out of the said FIR.

Today, the Respondent No.2, who is present in the Court, states that he has no objection if the said FIR is quashed. The parties have been identified by their learned counsel and Investigating Officer concerned. The parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering that the Closure Report has already been filed, nothing further survives in the present Petition and the FIR No.348/2025 under Section 3(1)(r)/3(1)(s) of SC & ST (P) Act, registered at Police Station K.N. Katju Marg and all the consequential proceedings emanating therefrom are quashed.

The Petition is disposed of accordingly.
