W.P.(CRL) 559/2018 Petitioner is seeking extension of parole which is stated to be expiring on 22.02.2018. The last extension had been granted to the petitioner vide order of this Court dated 01.02.2018 which was an extension for a period of 3 weeks considering the medical condition of the father of the petitioner who had been diagnosed with a tumour which is suggestive of malignancy. This Court notes that earlier period of parole enjoyed by the petitioner was for a period of 4 weeks meaning thereby that up to 22.02.2018 he is on a continuous parole for a period of 7 weeks.

Learned counsel for the State opposes this application. His

submission is that the petitioner has visited the hospital only once after 01.02.2017 i.e. on 17.02.2017. The petitioner has one elder brother living in the same vicinity who can watch the medical condition of his father.

Learned counsel for petitioner points out that the medical report of the father of the petitioner dated 18.02.2018 suggests that the father of the petitioner is suffering from Bronchitis and this has aggravated his condition. The petitioner had again visited the hospital along with his father on 19.02.2018.

The petitioner must make alternative arrangement as it is not as if the disease is going to culminate; the prognosis of the disease will take time. However, noting the aforenoted urgent medical condition of the father of the petitioner, petitioner is granted extension of parole for a period of two weeks to be counted from 22.02.2018 on the same terms and conditions. Needless to state that the petitioner shall surrender himself to the Jail on the expiry of the aforenoted extended period of parole of 2 weeks.

Petition disposed of.

A copy of this order be sent to Jail Superintendant concerned. Order dasti.
