This petition is filed seeking anticipatory bail in FIR No.276/2016 under Sections 326/34 IPC, P.S. Bhalswa Dairy. 2.

Counsel for the petitioner states that the FIR is of 2016, basis an allegation by complainant at the wedding of his acquaintance. He had an argument with three boys and one of the boys, who was wearing a green shirt, slapped one, Mr. Mishra. Complainant then intervened and one of the boys grabbed him by the neck and hit him 2-3 times with a stick, causing an injury to his left eye.

Petitioner's counsel states that the petitioner is only 26 years of age, and neither does he have anything to do with the alleged offence nor was he named in the FIR. Besides, the matter pertains to 2016 and he has shifted to his native place in Uttar Pradesh and has never received any notice. 4.

investigation as and when summoned by the I.O, he shall not be arrested till the next date of hearing.

It is informed by the APP, on instructions, that petitioner has joined investigation. He further states that investigation is almost complete and charge-sheet will be filed shortly.

As per the status report, co-accused Sudhir, who was part of scuffle which occurred, is also on bail.

Status report be placed on record by the APP. 8.

Counsel for petitioner states that permanent address of petitioner has been provided to the IO. Further, petitioner will continue to join and cooperate in the investigation, on the dates on which, he is summoned. 9.

Subject to this undertaking being complied with, this petition is allowed and petitioner is granted anticipatory bail. 10.

Consequently, in the event of arrest the petitioner be released on bail on furnishing a personal bond in the sum of Rs. 25, 000/- with one surety of the like amount subject to the satisfaction of the arresting officer/IO/SHO concerned, further subject to the condition that the petitioner will join investigation as and when directed and not influence any witness/complainant/victim or tamper with evidence of the case. 11.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
