The present petition has been filed assailing the impugned order dated 20.05.2025 passed by the learned Principal District & Sessions Judge in Criminal Appeal No. 43/2024 titled as "Siddharth Panghal v State & Ors", whereby the appeal of the petitioner was dismissed for non-prosecution as well as for non-compliance of the Court's order. 4.
The Criminal Appeal was preferred by the petitioner against the order dated 07.02.2024 of the learned MM (North), Rohini Courts, New Delhi in Ct Case No. 1980/2019 whereby the interim maintenance of Rs 50,000/- per month was awarded to the respondents.

Mr. Manish Kaushik, learned counsel appearing on behalf of the petitioner submits that the appeal of the petitioner has solely been dismissed on the ground of non-compliance of the Court's order. He submits that the only non-compliance was that the petitioner was not able to pay the arrears of maintenance. He submits that the appeal could not have been dismissed depriving the petitioner's hearing on merits only on the ground of nonpayment of the arrears. However, without prejudice to his rights and contentions, on instructions from the petitioner, he submits that the petitioner shall continue to pay to the respondents' maintenance @ Rs 15,000/- per month voluntarily.

That apart, the petitioner shall also pay an amount of Rs 2 lakhs towards the outstanding arrears in the following manner:- (i) An amount of Rs 40,000/- shall be paid on or before 30.11.2025. (ii) An amount of Rs 60,000/- shall be paid on or before 31.12.2025. (iii) An amount of Rs 30,000/- shall be paid on or before 31.01.2026. (iv) An amount of Rs 30,000/- shall be paid on or before 28.02.2026. (v) An amount of Rs 40,000/- shall be paid on or before 31.03.2026. 7.
Learned counsel appearing on behalf of the respondents submits that the said amount will be accepted by the respondents only without prejudice to the respective rights and contentions.

Accordingly, with the consent of the parties, the impugned order is set aside and the appeal is remanded to the learned Appellate Court for deciding the same on merits.

The present petition stands disposed of.
